General Terms and Conditions of Use
Preamble
The www.thedragonmaiden.com website (hereinafter the "Site") is published and operated by Dragon Maiden 雌龍 ("Dragon Maiden", "we", "us"), an independent atelier of women's apparel. Dragon Maiden's registered office is indicated in the "Contact" section of the Site.
The use of the Site and the purchase of any products offered on the Site are subject to these General Terms and Conditions of Use ("Terms and Conditions of Use") and the General Terms and Conditions of Sale (collectively the "General Terms and Conditions of Sale and Use") between you and Dragon Maiden, as well as the Privacy Policy of this Site. The use of the Site constitutes your acknowledgment that you have read, understood and accepted without reservation these General Terms and Conditions of Sale and Use, and your consent to the terms of the Privacy Policy for the Site (see "Security and Personal Data"), and that you agree to comply with them. If you do not agree to these General Terms and Conditions of Sale and Use and the Privacy Policy, you should immediately cease to access and/or use the Site.
The Site is not intended for use by minors. By accessing and/or using the Site, you represent and warrant that you are at least 18 years of age.
These Terms and Conditions of Sale and Use and the Privacy Policy may be updated at any time, and any changes will apply from the date such changes are published on the Site. The Terms and Conditions of Sale and Use and the Privacy Policy applicable at the time of using the Site are those that are applicable to you. Before using the Site every time, you should check the General Terms and Conditions of Sale and Use and Privacy Policy to ensure you understand and accept the terms that apply at that time. Your continued use of the Site after any changes constitutes your acceptance of such change. If you do not wish to accept the revised Terms and Conditions of Use or the Privacy Policy, you should not continue to access and/or use the Site.
We also advise you to keep regularly informed of the applicable terms and conditions. You can view the applicable version of the Terms and Conditions of Use, the General Terms and Conditions of Sale, or the Privacy Policy at any time by clicking on the "Terms and Conditions" and "Privacy Policy" hyperlinks.
1. Security and Personal Data
The use and processing of any personal data that may be collected, supplied, provided, generated or otherwise obtained from or in relation to use of the Site are governed by the Privacy Policy. The Privacy Policy of the Site, incorporated by reference in these General Terms and Conditions of Sale and Use, sets out how the personal information you provide will be collected, held, used, stored, processed and disclosed. Where needed, Dragon Maiden may modify or amend the Privacy Policy at any time as provided in the Privacy Policy.
2. Intellectual Property
All materials featured on or relating to the Site (including but not limited to photographs, drawings, diagrams, maps, designs, models, illustrations, images, sound recordings, sound tracks, films, video clips, data compilations, page layout, underlying code (including without limitation object and source codes), computer programs and/or software, texts, logos, icons, trademarks, typographical arrangements), except those within or relating to any third party websites, third party materials and/or any third party link (which rights, title and interests are retained by the third party(ies) who own(s) the respective third party websites, third party materials and/or third party links), are the exclusive property of Dragon Maiden or its subsidiaries or affiliates. You may not, by any means or process, whether in whole or in part, copy, reproduce, extract, adapt, translate, distribute, disseminate, publish, communicate, transmit, re-use, or otherwise create derivative works based on, modify or sell any such materials contained or featured on or relating to the Site. These materials are protected by intellectual property laws such as copyright or similar laws around the world. Dragon Maiden and its subsidiaries and affiliates fully reserve all rights, title and interests (including without limitation all intellectual property rights) not expressly granted under these General Terms and Conditions of Sale and Use.
You may not, nor may you allow or assist any third parties to, in relation to any items, works or materials within, featured on or relating to the Site (whether in whole or in part) (i) make, communicate, issue and/or distribute copies thereof, or (ii) copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, adapt, translate or otherwise create derivative works thereof, or (iii) attempt to do any of the foregoing prohibited acts.
The "Dragon Maiden" trademark, the "雌龍" character mark, and all other Dragon Maiden-related trademarks and logos, and all intellectual property rights (including without limitation patents, trade marks, service marks, trade names, design rights, copyright, domain names (e.g. "thedragonmaiden.com"), database rights, rights in know-how, trade secrets, inventions, designs or processes and other intellectual property rights whether now known or created in future (of whatever nature and wherever arising) and in each case whether registered or unregistered and including without limitation applications for the grant of any such rights and the right to claim priority) within, displayed or featured on, and/or in relation to the Site are and will remain the exclusive property of Dragon Maiden and/or its subsidiaries and/or affiliates. Any reproduction, distribution, communication, transmission, dissemination, publication, translation, adaptation, modification or use of any of these trademarks or intellectual property rights for any purpose whatsoever without prior and express agreement of Dragon Maiden is prohibited. You may not remove any copyright (including without limitation moral rights), trademark or other proprietary notice contained on the Site or any content contained therein.
You must not use any of the items, works, materials and/or content on our Site for commercial purposes without obtaining prior written consent or a licence from us. If you print off, copy, download, communicate, publish and/or disseminate any part of our Site in breach of these Terms and Conditions of Use, your right to use the Site will cease immediately and you must, at our request, return or permanently destroy any copies of the items, works and/or materials you have made.
You may use the Site for legal/lawful and personal purposes only. Specifically, you agree that you will not (i) use the Site, or any content, works and/or materials contained in or relating to the Site for or in connection with purposes that are, or in any manner which is, unlawful or illegal (including, but not limited to, purposes or manners which may infringe any of Dragon Maiden's and/or any third party's privacy, intellectual property rights and/or other rights, or otherwise for any purposes or usage which may adversely affect Dragon Maiden's reputation); and/or (ii) copy, extract, or otherwise exploit or use any content and/or materials contained in or relating to the Site with a view to creating or compiling any form of collection or compilation of data, directory or database.
3. Linking
The Site may contain links to third party websites or materials that are not published or controlled by us. Such links are provided as a convenience and for your information or reference only and cannot, and may not be interpreted as, an express or implied endorsement, recommendation or approval by us of such websites, their content or any business, products or services offered thereon.
You agree that we shall not be responsible or liable for the third party links, websites or any materials or content therein, or for any direct or indirect loss or damage that may arise from your use or the availability of any such third party materials, links and/or websites, and/or any actions taken by you consequent to or upon your reliance on or use of these third party materials, links and/or websites.
You agree that we shall not be liable or responsible in any way in relation to any products, services, contents and/or aspects shown and/or contained in and/or relating to any third party websites, materials and/or links, including without limitation as to their accuracy, adequacy, availability, title, completeness, timeliness, validity and/or legality, and/or any representations and/or warranties made by any third parties in respect of the same.
You may only provide a link to the Site if expressly authorized in writing by Dragon Maiden.
4. Right to Suspend
We do not guarantee that the Site, or any materials and/or content on or relating to it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Site for business, operational and/or regulatory reasons, or if you breach any terms of these Terms and Conditions of Use. We will try, but have no obligation, to give you reasonable notice of any suspension or withdrawal. You are also responsible for ensuring that all persons who access the Site through your internet connection and/or electronic device are aware of these Terms and Conditions of Use and other applicable terms and conditions in connection with the use of the Site (including without limitation the General Terms and Conditions of Sale and the Privacy Policy), and that they comply with them.
5. Disclaimer of Warranty
To the fullest extent permissible under any applicable laws, we do not warrant or represent in any way (whether express, implied, statutory or otherwise), including but not limited to:
- any warranties of non-infringement, defect/fault-free, uninterrupted or secured use of the Site;
- the Site or any functions, content, materials and/or links contained in or relating to the Site will be uninterrupted, secured or is free from viruses, bugs, defects and/or faults (and that defects and/or faults will be corrected), data overwriting programs, trojan horses or other destructive material or harmful components;
- the information contained on the Site is accurate, complete or up to date.
The Site may contain technical inaccuracies or other defects and we do not warrant that such defects will be corrected. The Site and its contents are provided on an "as is" and "as available" basis. We expressly disclaim all guarantees, representations and/or warranties of any kind (whether expressed, implied, statutory or otherwise), including without limitation those regarding:
- the operation, features and functionalities of or relating to the Site;
- the usual conditions of use of the Site or other content, materials or information included or provided on or relating to the Site;
- the validity, accuracy, reliability, adequacy, timeliness, availability, usefulness and/or completeness of the Site or the results of use of or otherwise in respect of the Site, or of any content, materials, links, products or services listed or other materials or information included or provided on or relating to the Site for a usual or specific use, or any other sites linked to the Site (including but not limited to any third-party content, websites, materials, and/or links);
- the quality or compliance of the Site and/or any content, materials, links, products or services on or relating to the Site with any statutory provisions or any laws or regulations;
- your ability to access or use any or all of the foregoing.
This disclaimer and exclusion of guarantees, representations and/or warranties shall apply to the fullest extent permitted by law. You agree that we shall not be responsible or liable in any way for any direct, indirect, special, incidental or consequential losses and/or damage suffered by you or any third party arising therefrom or in connection therewith. You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software at your own costs and expense. You must not use or otherwise misuse the Site by knowingly introducing, transmitting or uploading viruses, trojans, worms, bugs, logic bombs, time bombs, bots, or other code, software or material that is malicious or technologically harmful, destructive or disruptive. You must not attempt to gain unauthorised access to, break into, or trespass the Site, the server on which the Site is stored or any server, computer, database or information relating to or in connection with the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you may incur liability under applicable law, and we reserve the right to report any such breach to the relevant law enforcement authorities and/or to take action against you.
All content, products and services, and any other materials and information provided in the Site are intended for general information purposes only. No part of the Site is intended to constitute any advice or suggestion. You shall carry out independent judgment when using the Site, its content, products and services and other materials and information included or provided therein.
6. Limitation of Liability
Under no circumstances (including, but not limited to, negligence, omission or default) shall Dragon Maiden and/or its subsidiaries and/or affiliates be responsible or liable to you or any third party for any direct or indirect, incidental, exemplary, special or consequential damages, costs or expenses (including but not limited to legal expenses) of any character, nature or kind whatsoever, whether foreseeable or otherwise, (including without limitation, loss of profits or other indirect losses, business interruption or loss of information or data) arising out of, from or otherwise in connection with the operation of the Site and/or your use or inability to use the Site, whether based on breach of contract, tort (including but not limited to negligence), product liability or otherwise, even if Dragon Maiden or any of its representatives have been advised of the possibility of any such damages. You should be aware that any access to or use of the Site and any information, contents and materials therein (including but not limited to the content and/or any third-party websites, materials and/or links) are at your own risk. This limitation of liability shall apply to the fullest extent permitted by law.
Nothing in these Terms and Conditions of Use shall exclude or limit Dragon Maiden's liability for death or personal injury caused by Dragon Maiden's negligence, or for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
You agree to fully indemnify and on demand, defend and hold harmless Dragon Maiden, together with its respective agents, officers, directors, employees, representatives and/or suppliers, from and against all claims, liabilities, damages, losses, demands, costs and expenses (including without limitation all legal fees and expenses), that may be incurred or suffered by us and/or any of the foregoing parties (whether directly or indirectly) arising out of, caused by, relating to and/or otherwise in connection with any breach of these Terms and Conditions of Use by you, including without limitation any breaches arising from your access to or use of the Site or any of its content, materials and/or services, as well as the use by any other person accessing the Site using your personal data.
7. No Text or Data Mining, Bot Access or Web Scraping
You shall not conduct, facilitate, launch, assist, authorise, use, support, develop or permit any text or data mining or web scraping or any automated access or any similar activities in relation to our Site or any services provided via, or in connection with, the Site. This includes without limitation using (or facilitating, assisting, permitting, authorising or attempting the use of):
- Any "robot", "bot", "spider", "scraper", "crawler" or other automated device, program, system, tool, algorithm, code, scripts, software, or other means or process or methodology to access, scan, scrape, crawl, obtain, copy, monitor or republish any portion of the Site or any data, object and/or source code (including but not limited to HTML source), content, materials, information or services contained in, relating to or in connection with the Site.
- Any automated analytical technique aimed at analysing text and data in digital form to generate information which include but is not limited to patterns, trends and correlations.
This term shall apply to the extent that we are able to exclude or limit text or data mining or bot access or web scraping activity or automated access by contract under applicable laws.
You acknowledge and agree that you shall not access and/or use the Site and/or its underlying object and/or source code (including but not limited to HTML source) via any automated means, or in any manner that breaches any terms of the General Terms and Conditions of Sale and Use. You also agree and acknowledge that you, as a visitor of the Site, shall not assist, procure and/or induce any person or entity to (i) breach any term of the General Terms and Conditions of Sale and Use and/or (ii) otherwise circumvent any access restrictions imposed by Dragon Maiden in relation to the Site.
8. Governing Law and Jurisdiction
These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which Dragon Maiden is registered. You agree to submit to the non-exclusive jurisdiction of the competent courts of that jurisdiction. These Terms and Conditions of Use are drafted in English.
9. Miscellaneous
Waiver: The failure of Dragon Maiden to exercise or enforce any right or term of these Terms and Conditions of Use will not constitute a waiver of such right or provision. Any waiver of any term of these Terms and Conditions of Use will be effective only if in writing and signed by Dragon Maiden.
Severability: If any provision or part-provision of these Terms and Conditions of Use shall be held by any court or competent authority to be unlawful, void or unenforceable, in whole or in part, such provision (or parts thereof) shall, to the extent required, be severed from these Terms and Conditions of Use without affecting the validity or enforcement of the remaining provisions (or parts thereof) of these Terms and Conditions of Use.
Assignment: These Terms and Conditions of Use, and any rights and licences granted hereunder, may not be transferred or assigned by you, but may be assigned by Dragon Maiden without restriction.
Entire Agreement: This is the entire agreement between you and Dragon Maiden relating to the use of the Site and will not be modified except by a change to these Terms and Conditions of Use by Dragon Maiden.
Third Parties: Except for Dragon Maiden and its subsidiaries and/or affiliates (if applicable), any person who is not a party to this Agreement shall have no right to enforce any of the provisions hereunder. For any rights conferred on third parties by these Terms and Conditions of Use, their consent is not required to rescind or vary these Terms and Conditions of Use.
General Terms and Conditions of Sale
Preamble
Please read carefully the General Terms and Conditions of Sale and the General Terms and Conditions of Use (collectively the "General Terms and Conditions of Sale and Use") of the thedragonmaiden.com website.
1. Seller's Identification
These General Terms and Conditions of Sale are those of Dragon Maiden 雌龍 (hereinafter "Dragon Maiden" or "we/us"), an atelier of women's apparel operating the Site.
2. Scope of Application and Acceptance
The purchase of any Dragon Maiden brand products ("Products") offered on the www.thedragonmaiden.com website (hereinafter the "Site") is subject to these terms and conditions of sale for the Site ("Terms and Conditions of Sale"). The Products are exclusively intended to be sold to end consumers, natural persons or corporations, with the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, you warrant that in using the Site and/or purchasing any Product on the Site, you are acting as the end consumer and you agree that you shall not, and shall not intend to, resell the Products for commercial (or any other) purposes.
Dragon Maiden may update these Terms and Conditions of Sale at any time, and users of the Site are deemed to be aware of, and bound by, any such revisions upon publication on the Site. You can view the applicable version at any time by clicking on the hyperlink labelled "Terms and Conditions". The Terms and Conditions of Sale applicable at the time of entering into the contract of sale are those which are binding on you.
In addition, for each purchase of Products on the Site, you will be requested to confirm your acceptance of the current Terms and Conditions of Sale applicable at the date of your order. The said terms and conditions may be viewed prior to and at the moment when you are prompted to confirm that you accept them. To indicate your acceptance, you will need to check the box "I have read and accept the General Terms and Conditions of Sale and Use of the Site, as well as the Privacy Policy."
3. Ordering Scope
The Site may be used to order a selection of Products from Dragon Maiden, directly online via the Internet for delivery to the territories listed in the "Shipping Policy" (see section "8.1 Delivery Area" below).
The Site does not permit the placing of special orders that notably consist in the creation of a product that does not exist in our current range of products, or is no longer in the Dragon Maiden collection, a bespoke product or the adaptation or customisation of a product from Dragon Maiden's collections. These Terms and Conditions of Sale therefore do not apply to special orders.
4. Availability of Products
Our Product selection and prices are valid as long as they remain visible on the Site, subject to availability. Exceptionally, errors or changes may be made, especially in cases of simultaneous orders of the same Product by several customers. If a Product is unavailable after ordering, we will inform you of such unavailability by email as soon as possible. You will then be presented with the choice to order an alternative Product from the Site or to cancel your order. For avoidance of doubt, any alternative Product can only be chosen from the Products available on the Site.
Dragon Maiden shall not be liable if Products are out of stock or unavailable for orders that have not yet been accepted by Dragon Maiden. For the avoidance of doubt, any purchase order by the customer constitutes an offer for purchase, and Dragon Maiden has the right to accept or reject any purchase orders of Products from customers (Dragon Maiden's email notifying you that the order request has been received is only an acknowledgement of your offer but not a confirmation of your order, and does not constitute any form of contract between you and us). Dragon Maiden's acceptance of your order will only take place when we notify you by email that your order has been shipped, at which point a contract will come into existence between you and us.
Dragon Maiden reserves the right to change the Products available on the Site at any time and without any prior notice. In order to improve service quality and ensure greater availability of our Products for all customers of the Site, Dragon Maiden reserves the right to limit the number of Products which can be purchased per customer. As such, given the limited availability for some of our product line, Dragon Maiden reserves the right to limit the quantity of products available for purchase per customer at its sole discretion at any time and shall have the final decision.
5. Ordering Procedure
5.1. Selecting Products
You may at any time add Products to your selection by clicking on "Add to cart", and choose to complete your order or continue shopping.
You may view your selection by hovering over it or by clicking on "Cart" in the menu on the top right hand side, where photograph(s) of the Product(s), colour and reference number(s), the quantity selected, unit price(s), and the subtotal for the selection will be displayed. You can also choose the area of delivery. The default shipping method and any applicable shipping costs will be displayed at checkout.
5.2. Login
Once you have selected the Product(s), click on "Continue to checkout" to begin the process of placing your order.
If you already have a customer account, you will be required to log in and enter your password at this stage. If you do not yet have an account, you will be prompted to create one by confirming your email address and other required information and subsequently creating a password at the "Payment" stage.
The Privacy Policy, incorporated by reference in these General Terms and Conditions of Sale, sets out how the personal information you provide will be processed. Your login and password are strictly for personal use. Consequently, you undertake to store them safely and never disclose them to third parties. You are solely responsible for the security of the log-in and password of your customer account, and may be held liable for any loss, theft or fraudulent use of your customer account if you have not taken reasonable care; and you must inform Dragon Maiden at global@thedragonmaiden.com immediately if you become aware of any third party gaining access to your login, password or account. You agree to indemnify us entirely against any and all losses attributable to any access to and/or use of your customer account (including access and/or use for the purchase of, and the placing of orders for, any Products) referable or traceable to your username and password.
Once you have created an account you will be able to:
- Access your shopping cart
- Access all your orders and download the related sales memo duplicate
- Manage your address book to order faster
- Check, correct and delete your personal data
- Manage your newsletter subscription
The data recorded by the Site constitutes proof of all transactions made between Dragon Maiden and its customers. In the event of a dispute between Dragon Maiden and one of its customers about a transaction made on the Site, the data recorded by Dragon Maiden will be considered as irrefutable proof of the content of the transaction.
You may have your account deactivated at any time by sending an email to global@thedragonmaiden.com, and to the extent such account has any pending orders that have not been completed, it will only be deactivated after such completion. After your account has been deactivated, you are free to create a new one at any time.
5.3. Order Confirmation
5.3.a) Confirmation of shipping method
You will be required to confirm the shipping method and to enter the delivery details needed to ship your order successfully: shipping area, title, surname, first name, phone number, delivery address and other necessary information. The customer must ensure the delivery address provided to Dragon Maiden is accurate and complete as the successful delivery to the delivery address provided by the customer shall discharge Dragon Maiden from any responsibility.
When confirming the shipping method, you will have the option, for a gift order, to include a cover card and a gift receipt.
Once you have completed this step, click "Confirm".
5.3.b) Confirmation of payment method and payment of order
You may use your delivery address as your billing address or enter a different address. You will then be prompted to select a payment method and enter the relevant information.
At the end of the ordering procedure described above, once you have accepted in their entirety the Terms and Conditions of Sale and Use herein and the Privacy Policy for the Site, click the "Confirm and pay" button.
You must carefully check that your selection is correct before confirming your order. While every effort is made to ensure that the colour and design of the Products in the photographs displayed on the Site match those of the original Products, variations may occur, in particular due to colour display constraints on your device. Consequently, Dragon Maiden shall not be held liable for any insubstantial error or inaccuracy in the photographs or graphic representations of the Products included on the Site. In the event of queries regarding the Products, you may of course contact us at global@thedragonmaiden.com.
For more information concerning payment methods, please refer to the section "6. Price – Methods of Payment Accepted" below.
When finished, your order is transmitted to Dragon Maiden for processing for the purposes of assessing whether or not your order is accepted by Dragon Maiden. We will send an email to the email address you have provided acknowledging our receipt of your order, and that we will process such order.
Dragon Maiden reserves the right to not accept any order placed by a customer at its discretion and without having to provide any reason to such rejection, including but not limited to where there is an existing dispute with the customer concerning a prior order, or Dragon Maiden has reasonable cause to suspect that such customer has violated these Terms and Conditions of Sale, or is engaged in any fraudulent activity, or on any other legitimate grounds.
5.3.c) Confirming the order
If your order is accepted by Dragon Maiden, you will subsequently receive another email notifying the shipping of the order. The receipt of the email notifying the shipping of the order is the point where a contract will come into existence between you and us.
Unless otherwise regulated by law or under special condition of General Terms and Conditions of Sale, once the order has been accepted by us, you shall not be able to change or cancel the order. In case you have the right to cancel the order, if you have already made the payment, after deducting the cost of Dragon Maiden (subject to the unilateral decision of Dragon Maiden based on the actual cost, such as delivery cost, if any), Dragon Maiden will return all remaining payment received to the original payment account.
The above clauses shall not restrict the return and exchange rights set out in the Refund Policy.
6. Price – Methods of Payment Accepted
6.1. Price
The prices of the Products are displayed on the Site in the currency selected at checkout, inclusive of applicable taxes where indicated. Duties and import taxes for international destinations may be additional and remain your responsibility, unless otherwise stated at checkout.
Dragon Maiden reserves the right to amend the prices of the Products on the Site at any time and without any prior notice. Products are invoiced on the basis of a price list posted on the Site at the time of your order, subject to the availability of the Products ordered at this time.
If any of the ordered Products are unavailable (see Section 4 "Availability of Products"), only the price and the shipping costs (if any) of the available Products will be charged. For the avoidance of doubt, if the order has not been accepted by Dragon Maiden, the payment will not be processed and you will not be charged.
6.2. Methods of Payment Accepted
6.2.a) Payment by credit card or debit card
We accept payment by the following credit cards and debit cards: MasterCard®, Visa®, American Express®, JCB®, Discover® and Union Pay®. Payments are authenticated and secured by the 3D Secure system, also known under the names "Verified by Visa®", "MasterCard® SecureCode" or "American Express SafeKey®". During payment, the bank asks the Internet user for his/her personal information in order to check the identity of the cardholder and to validate the transaction.
After validation of your banking and credit card details (card number, expiry date and card verification number), a new page will be displayed on which you have to enter the personal information requested by your bank. This information can be the answer to a personal question; a password you have previously chosen; a code sent by SMS; and/or your date of birth.
Once the 3D Secure code is entered and validated by your bank, your order is complete. You will then receive an email notifying that we have received your order.
Authentication is specific to each bank. For any questions concerning your 3D Secure code, please contact your bank directly. Please also note 3D Secure is operated by third parties other than Dragon Maiden, and is subject to the applicable terms and conditions of such third parties.
Your order will only be processed after your payment method has been verified and upon receipt of your card's debit authorisation. Your account will only be charged when the Products are dispatched, except for pre-orders, in which case your account will be charged at the time the order is placed.
If you use a credit card issued by an overseas issuer, additional service charges may be applied by third party credit card issuers and your payment to us may be subject to currency conversion rates decided by such third party credit card issuers. Further, when you apply for a refund upon return of the Product, we will only refund the amount you originally paid, and we will not be responsible for the exchange rate difference to any foreign currency or any service charges of your credit card issuers.
6.2.b) Payment by digital wallet
We accept payments through supported digital wallets where available. These methods of payment are compatible with devices on which you have entered your information in the relevant application.
Before confirming the payment, please verify that the information linked to your digital wallet account is correct, in particular the delivery address provided. Dragon Maiden will not be responsible for replacement or refund of the Products if the information provided on your wallet account is incorrect.
6.2.c) Store credit
Store credit and gift cards issued by Dragon Maiden may be redeemed against Products on the Site, subject to the conditions stated at issuance.
7. Title Retention
The Products ordered and shipped remain the property of Dragon Maiden until full payment for the Products has been received by Dragon Maiden.
However, you assume the risks (in particular regarding loss, theft or damage) relating to the ordered Products from the moment they are delivered to the address specified when placing your order.
8. Shipping Methods
8.1. Delivery Area
Products purchased on the Site may be shipped to the destinations listed in the Shipping Policy (hereinafter the "Delivery Area"). Orders cannot be placed for delivery addresses situated outside this Delivery Area.
Notably for security and authenticity reasons, Dragon Maiden shall not process any order for which a general delivery address, a P.O. box, a parcel locker, a parcel pick-up service address, or a freight-forwarding company address has been provided.
The Products will be shipped to the delivery address specified when placing your order. The customer must ensure the delivery address provided to Dragon Maiden is accurate and complete as the successful delivery to the delivery address provided by the customer shall discharge Dragon Maiden from any responsibility.
A signature may be requested from you by our designated shipping company to acknowledge your receipt of your Products ordered.
We can deliver to your hotel. Please provide the name and address of your hotel when you place your order so that we can have your package delivered within the given time frame. If we are unable to deliver within this time frame, we will contact you to give you prior notice.
8.2. Shipping Costs
Standard shipping is offered complimentary on orders above the threshold shown at checkout. If you choose other chargeable shipping methods available on the Site (if any), you shall make your own choice before submitting the order and Dragon Maiden will charge the relevant shipping cost as stated on the Site.
Note: In case you choose a chargeable shipping method and pay the shipping cost, the shipping cost will not be refunded in case of return.
8.3. Time Required for Delivery
The delivery times indicated on the Site are counted from the time of Dragon Maiden's acceptance of your order.
On the Product ordering page, we will provide you with the estimated timeframe required for delivery and the shipment method available for the purchased Products and the Delivery Area. The price of shipping (if any) will be due in addition to the price of the purchased Products.
Orders are shipped via a third-party service provider. Under normal circumstances, please allow the timeframes indicated in the Shipping Policy. Kindly note that orders will not be processed during weekends and public holidays; if you place an order later than 12:00 pm of the day before a weekend or public holiday, your order will only be processed on the next business day.
For Products which are already indicated on the Site as having a possibility of delayed delivery or a longer delivery period, Dragon Maiden reserves the right to delay the delivery.
Please note that whilst every effort is made to meet the delivery times quoted, Dragon Maiden does not provide absolute guarantees. The Site uses reputable couriers for their prompt and efficient service but occasionally, due to unforeseen circumstances, delays may occur.
9. Delivery Problems
9.1 Delivery Problem Notice
In case any of the below issues happens, you shall notify us immediately: 1) Any failure to deliver; or 2) late delivery exceeding eight (8) business days ("Delivery Problem Notice"). As soon as we receive your Delivery Problem Notice, we will investigate into the relevant delivery problems.
Once we have confirmed that the Products failed to deliver to the address provided, the sale contract between you and Dragon Maiden in relation to the relevant Product will automatically terminate without further action required. We will then contact you for refund. In order for your claim to be considered by us, please be sure to contact Dragon Maiden within ten (10) business days from the date of receiving the message of noticing the shipping arrangement of your order. No claims notified to us more than ten (10) business days from that date will be taken into account.
9.2 Inability to deliver after reasonable attempt
We strive to deliver our pieces to you. At times, we may not be able to deliver the Products to you after reasonable attempt. If our Products cannot be delivered to the address provided by you for 3 consecutive times, we will contact you by email to inform you that your Products cannot be delivered despite reasonable attempt and that we will refund you.
The sale contract between you and Dragon Maiden in relation to the relevant Product will automatically terminate without further action required, at the earlier of (i) our communication with you or (ii) our email to you about inability to deliver the Products to you after reasonable attempt.
9.3 General
The successful and timely delivery to the delivery address provided by the customer shall discharge Dragon Maiden from any responsibility. Subject to the customer providing an accurate and complete address, in the event of failure to adhere to the delivery time, you can cancel the order by emailing global@thedragonmaiden.com.
Dragon Maiden shall be bound to refund you the full amount paid, at the latest within fifteen (15) business days of the date of the termination of the sale contract (the timing for receiving the refund may vary subject to the bank's processing). However, if you receive the Product after having exercised this right, you must return it in accordance with the return procedure indicated in the Refund Policy.
For the avoidance of doubt, your rights under this Section 9, to the fullest extent permitted by law, and the full refund to you by Dragon Maiden shall be your sole and exclusive remedy at law or equity in relation to Products and services of Dragon Maiden.
You should check for any lack of conformity in the Products at the time of delivery and, if any anomalies are found (e.g., open package, damaged goods, etc.), we recommend that you handwrite any observations, if possible on the delivery note, and sign it.
You should then contact us by email at global@thedragonmaiden.com. If the goods do not conform to your order or you are not satisfied with them, you may return them or ask for an exchange or a refund pursuant to the terms and conditions set forth in the Refund Policy.
10. Right of Returns, Exchanges and Refunds
The general refund policy of Dragon Maiden is governed by the Refund Policy, which is incorporated by reference into these Terms and Conditions of Sale. Subject to applicable law, the rights, conditions, and procedures for return, exchange, and refund are as set out in the Refund Policy.
11. After-sales Service
An after-sales service is provided for any Product that is technically repairable, subject to applicable after-sales service terms. For any repairs, please contact us at global@thedragonmaiden.com.
Dragon Maiden cannot guarantee a period of availability for spare parts or replacement materials required for the use of Products. Nevertheless, Dragon Maiden will do its utmost to satisfy its customers in the event that one or more parts are requested.
12. Limitation of Liability
Under no circumstances may Dragon Maiden be held liable for any damage not resulting from a failure on the part of Dragon Maiden to comply with one of its obligations. Dragon Maiden shall not be liable to you for any indirect, consequential, special and punitive damages, or for any damages resulting from loss or interruption of business, lost data or lost profits, arising out of or relating to these Terms and Conditions of Sale, whether liability is based on contract, breach of warranty (express, limited or otherwise), tort (including negligence and strict product liability) or otherwise, and irrespective of whether we have advised or been advised of the possibility of any such damages.
To the maximum extent permitted by applicable law, the total aggregate liability of Dragon Maiden to the Customer under these Terms and Conditions of Sale shall not exceed the amount of sales of the given transaction between Dragon Maiden and the customer giving rise to the claim.
Nothing in these Terms and Conditions of Sale shall operate to limit or exclude Dragon Maiden's liability arising from any death or personal injury caused by Dragon Maiden's negligence.
13. Governing Law and Dispute Resolution
These Terms and Conditions of Sale are governed by and construed in accordance with the laws of the jurisdiction in which Dragon Maiden is registered.
In the event of any dispute, controversy or claim arising out of or in connection with these Terms and Conditions of Sale — including its existence, validity, interpretation, performance, breach or termination — the parties shall first seek to resolve the matter amicably through good-faith negotiation. If the matter cannot be resolved within thirty (30) days after the commencement of such negotiation, either party may bring the dispute before the competent courts of the jurisdiction in which Dragon Maiden is registered, whose non-exclusive jurisdiction you agree to submit to. These Terms and Conditions of Sale are drafted in English.

14. Other Important Terms
14.1 Assignment
These Terms and Conditions of Sale shall be binding upon and inure to the benefit of us and you, and any successors and permitted assigns of us and you. You may not assign or transfer any of your rights, benefits or obligations under these Terms and Conditions of Sale without our prior written consent. No assignment shall relieve or discharge you of any of your obligations or liabilities hereunder. We shall be entitled, in our discretion, to delegate or subcontract the performance of any of our functions in connection with the performance of our obligations under these Terms and Conditions of Sale.
14.2 Waiver
No failure on our part to exercise, and no delay on our part in exercising, any right or remedy under these Terms and Conditions of Sale will operate as a waiver thereof, nor will any single or partial exercise of any right or remedy preclude any other or further exercise thereof, or the exercise of any other right or remedy.
14.3 Illegality and Severability
In the event that any of the provisions of these Terms and Conditions of Sale shall be, or at any time shall become, invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not in any way affect or impair any other provisions in these Terms and Conditions of Sale, but these Terms and Conditions of Sale shall be construed as if such invalid or illegal or unenforceable provisions had never been contained herein.
14.4 Third Party Rights
Save as expressly provided for in these Terms and Conditions of Sale, a person who is not a party to these Terms and Conditions of Sale shall not have any right to enforce any provision of these Terms and Conditions of Sale.
14.5 Entire Agreement
These Terms and Conditions of Sale supersede and cancel all previous agreements, warranties and undertakings, whether oral or written, express or implied, given or made by or between us and you, and constitute the entire written agreement between us and you, in respect of the matters set out herein, and no other terms and conditions shall be included or implied.
